摘要
我国《合同法》第286条及2002年6月最高人民法院的司法解释赋予建筑工程承包人以优先受偿权,保证了承包人就其建设工程的价款优先于抵押权人和其他债权人受偿,但不可避免地对作为抵押权人的贷款银行造成了影响,加大了其房地产贷款的风险。本文通过对承包人优先受偿权的法律性质及其对商业银行房贷风险之影响加以讨论,提出了立法建议和在现行法律环境下银行控制风险之对策。
The article 286 of contract law and interpretation given by the people 's supreme court in 2002 provide entitle project's contractor to have the prio rity of compensation of construction project costs. This provision makes bank's home loan more dangerous. In this paper,the author analyse the nature of the Pri ority of Compensation and its influence on bank's home loan.In the end,the auth or put forward countermeasures and suggestions.
