对我国死刑适用标准的反思和重构

Consideration and Restructure of Standards of Death Penalty in China

本文通过对我国死刑政策和我国刑法中的死刑适用条件的分析,认为我国的死刑政策宜表述为“严格死刑适用标准”。由于我国刑法分则中的死刑适用标准在一定程度上背离我国的死刑政策及我国刑法总则中的死刑适用标准———“罪行极其严重”,因此应当按照死刑只能适用于“最严重的犯罪中最严重的情形”的精神对我国刑法分则中的死刑适用标准进行改造。

By observing the policies related to the death penalty in China and the imposition of the death penalty in the Criminal Act, this author determines that it is appropriate to address China's death penalty policies as 'strict death penalty standards.' Since the standards of imposition of the death penalty in the special provisions of the Criminal Act contradict in some degree with those in the general provisions of the Act, the standards in the special provisions should be modified in accordance with the principle that the death penalty can be imposed only on those that have committed 'the gravest crimes with the cruelest means.'
