公益诉讼制度探析

Analysis of Lawsuit system of public good

公民参与国家事务的管理是宪法赋予的权利和义务。然而,公民通过诉讼直接对侵害国家利益和公共利益的行为向法院起诉,由法院直接追究其违法责任,在我国司法界和法学界却是一个崭新的话题。笔者认为,在推进依法治国,建设社会主义法治国家的今天,设立公益诉讼制度,制裁侵害国家利益和社会利益的违法行为,势在必行。它的设立将对我国司法改革和社会主义民主实现形式提供新的思路和模式。

The management that the citizen participates in the national affairs is the right and obligation that constitution entrusts to.However,the citizen brigns a suit before court in encroaching on the behavior of national benefit and public interests directly through the lawsuit,the court investigates its illegal responsibility directly,but a brand-new topic in the judicial circle of our country and law circles.I think,is moving forward and running the country according to alw,today to build the socialist country governed by law,set up the lawsuit system of public good,punish and encroach on the illegal activities of national benefit and social interests,imperative.Its establishment will offer the new train of thought and mode to the judicial reform of our country and way of realization of socialist democracy.
