论解约条款在航次租船中的运用

On the Application of Concelling Clause in the Voyage Charter Party

众所周知，国际间海上货物运输，除杂货船运送货物依赖公约具有一定的指导作用外，租船运输主要是根据契约自主原则，由合同双方自行商议订立。因此在订立租船合同时，合同条款内容的规定及解释对船东和租家正确履行合同具有十分重要的意义。目前标准合同格式如金康、纽约土产等都订有一系列较为常见的合同条款，这里我想着重阐述航次租船合同中解约条款的运用。

This paper intends to inquire into the application of concelling clause in theory and practice. First,the paper makes a brief introduction to the clause.Secondly,it discusses the legal nature of the concelling clause and the attention that the shipowner and charterer should pay in quotation of the clause.Thirdly,it states the damages due to breach of the clause.In contering the concelling clause,the author advances seven countermeasures for shipowners to protect their own benefit.
