摘要
《中华人民共和国海商法》(以下简称《海商法》)已于1993年7月1日施行，《海商法》第222条和第223条对海上保险法律关系中的被保险人所负的告知义务以及违反该义务的法律后果作了较详细的规定，这些规定既不同于《中华人民共和国财产保险合同条例》中的有关规定，也不同于英国1906年《海上保险法》中的有关规定，
The provisions in Articles 222,223 of'The Maritime Code of the People's Republic of China'(CMC)on the disclosure duty and legal effects due to a breach of the duty are different from the provisions in both the previous Chinese and English laws.CMC stipulates a strick disclosure duty upon the assured in a marine insurance contract,and open up a quite wide and technical gate for marine insurers to defend claims to which both the insurers and the assured may have a better alert.
