Comparative Study on Negotiable Instrument Laws

随着全球经济的日益一体化 ,票据的国际流通越来越频繁。但是 ,各国票据法之间的差异仍然显著 ,国际票据法律适用法在解决票据国际流通带来的法律冲突中依然具有重要作用。通过对国际票据法律适用法的比较 ,不难发现 ,各国的票据法律适用法在追求体现国际票据流通规律的过程中 ,逐渐形成了某些共同的特点和原则 ,即 :硬性冲突规范的普遍采用 ,“意思自治原则”的排除 ,分割制的普遍运用 。

With the integration of the global economy, the international circulation of negotiable instruments has become more and more frequent. But, the differences of the negotiable instrument laws among nations are still striking. So, the law of application of negotiable instrument laws is still playing an important role in solving the conflicts of negotiable instrument laws. It is not difficult to perceive through comparative study that the law of application of law of negotiable instruments has formed some common characters and principles: universal adoption of black-letter conflict rules, exclusion of the rule of autonomy of the will, universal application of Dépesage, the principle of lex personalis governing capacity of negotiable instrument and the principle of lex loci actus governing act on negotiable instrument.
