由于公司法人的团体性具有发展、变化和开放的特色,由于法人的实质在于其合法性,这两者均不以限定公司人数为必然前提。因此,中国公司法应允许一人公司的存在。

At least two persons are required to establish a company in accordance with China's Current Corporate Law. Directing against that provision, this article tries to advance some rationale for single member company from the perspectives of collectivity of a company and essence of a juridical person, with some innovative research methods. 
