On Incidental Appeal

附带上诉 ,是指当事人一方上诉后 ,被上诉人在上诉期间依附于该上诉而提起的上诉以及指被上诉人舍弃上诉或者在上诉期间没有提起上诉 ,当上诉人提起上诉后 ,被上诉人在上诉审程序中提起的上诉。附带上诉制度有助于公平地保护双方当事人的利益 ,防止诉讼拖延 。

Incidental appeal is an appeal which the appelle sue the appellant during the appellate period or an appeal which the appelle sue the appellant in appeal procedure when the appelle abandoned appeal right or he failed to sue the appellant during the appellate period. Incidental appeal system conduces to impartially protecting the parties benefit , preventing law' delay and realizing substantial justice to a great extent.
