The Practice Value of the Distinguishing Principle

区分原则,就是把因合同所生的债权变动的法律效力与因物权独立意思表示加以确定并以登记交付为标志所生的物权变动的效力区分开采的原则,该原则彻底理清了物权变动的原因(债权的变动)与结果(物权的变动)之间的关系。在民法实践上,区分原则不仅在合同生效但物权变动未能成就的情况下,充分肯定有效成立的合同的效力,保证合同当事人债权请求权的行使,从而维护合同当事人的利益;而且在第三人取得物权而合同当事人只享有债权的情况下,更利于保护第三人的正当利益,从而维护社会整体的正常交易秩序。
