摘要
《最高人民法院关于审理人身损害赔偿案件适用法律若干问题的解释》明确规定经营者具有安全保障义务,但对安全保障义务的适用条件规定的不明确。安全保障义务最起码应考虑四条件,义务主体、主观过错、侵权行为、侵权行为与损害结果之间的因果关系。
Although Interpretations on Issues of Laws Applicable to Cases of Compensation for Personal Injury by the Supreme People's Court clearly states that management of business have the obligation of security guarantee for employees, the stipulations for this obligation are not specified. The security guarantee obligation, at least, involves consideration of four stipulations, including subject of obligation, subjective fault, tort, and the cause and effect relationship between tort and its injury result.
