论民间戏曲艺术中“绝技”的法律保护——以川剧“变脸”绝技外传事件为线索

Law Protection of Exclusive Techniques in Folk Opera Thoughts ——Inspired by the Emission of "Face-changing" technique in Sichuan Opera

应当将川剧艺术中的"变脸"绝技作为"文化遗产",作为川剧的艺术标识而非商业标识来对待,对其保护的着眼点是如何防止淡化、歪曲其艺术标识作用的不当使用,而不是一味禁止外传。在准据法的定位上要充分融入民间艺术形式行规艺德的有益内容,"有机保护非物质遗产"。

'Face-changing' technique should be treated as 'cultural remains', brand of art other than commercial trademark of the Sichuan Opera. Instead of a complete ban on its spreading outwards, its protection should be focused on the misusing which will devalue or even distort its worth as a brand of art. Based on the low,favorable guild regulations and art morals should also be added as important part to the organic protection of non-material remains.
