摘要
《全国普通高等学校毕业生就业协议书》(简称《就业协议》)作为毕业生、用人单位及学校在高校毕业生就业意向上达成一致的合同文本,是解决就业协议争议的合法依据。但《就业协议》存在的种种不足,使其未能充分胜任好这一角色。笔者认为,完善《就业协议》,其一,学校应由协议当事人之一转变成协议的审批者或监督者;其二,《就业协议》的条款约定应当更加具体化。
Employment contract of College Graduates in China, as a contract agreed on by graduates, colleges and employers, is a legal weapon to resolve disputes over employment. However, some flaws in the contract prevent it from fulfilling such a role. The author holds that colleges should act as the supervisor rather than one party of the contract and at the same time, some articles in the contract should be specified.
