房屋租赁是现代生活越来越常见的现象,出租人和承租人之间往往因为一方或双方的意思表示不同而出现纠纷。典型的案例是在承租人擅自装修出租人的房屋时,出租人是否应当支付相应装修费用的问题。对承租人这种行为导致的出租人和承租人之间的利害关系,出现了承租人无因管理说、出租人不当得利说、添附说等几种常见的性质认定,但以承租人违约说来解决此类纠纷是比较恰当的方法。
The house leases is more and more common phenomenon in modern life. But the disputes appear between the lessee and the renter because different meaning within one party or two parties. The typical case is whether or not that lessee should undertake the decorating expenses when the renter decorated the lessee' s house without permission. There are some theories about the relation between the lessee and the renter such as the lessees management without reason,the renters unjust enrichment and the real estates attachment. But it would be the appropriate method to solve this kind of dissensions with the renter breaking the contract.
