摘要
我国刑法对破产犯罪规定的缺陷主要体现在两个方面:一是关于破产犯罪的主体限制过窄;二是对破产犯罪的行为方式规定较单一。我国破产犯罪的立法完善主要应考虑加强对破产保护的力度和提高破产犯罪的法定刑幅度。
There are two aspects of defect in the regulations of bankruptcy crime in Chinese Criminal Law: 1) too narrow in the subject limitation of bankruptcy crime; 2) too simple in the regulations of bankruptcy crime behavior. So we should take into account the force of bankruptcy protection and the degree of sentence in the legislation of Chinese bankruptcy crime.
