本文主要从著作权的角度讨论网络环境对知识产权制度的冲击:包括网络发表权问题,复制权问题,多媒体作品及数据库的著作权问题。表现为知识产权冲突范围扩大化、网络侵权多样化、权利冲突复杂化。冲突的根本原因在于网络空间与现实空间的差异和权利主客体的变化。由网络信息技术所引发的知识产权问题,是能够也必须用技术手段来解决的。

This article mainly discusses the impact to the intellecual property caused by the environment of the network in terms of the copyright, including the network issues right question, duplicate right question, multimedia works and copyright question of the database. It is shown as the magnification in conflict range of intellectual properly, the diversification of the network infringing, the complication of droit conflict. The basic reason of the conflict lies in the difference between cyberspace and realistic space and change of the subject and object of the right. It can be and must be solving intellectual property problems that are caused by information technology of the network by technological means.
