乡土社会中的法与理——一次乡村调查引发的思考

Law and principles in the country

本文通过对几个调查所得案例的分析,揭示在现代法治推行的过程中,在乡村社会存在着法与理的矛盾,并分析其原因。在此基础上,文章提出了现代法治建设对此应有的态度:尊重乡村社会的现实生活状态,努力寻找法与理的契合点,实现两者的良性互动。

Through analyzing several cases, the essay reveals the existence of contradiction between law and principles in the village in the process of promoting the construction of modern law, and try to analyze its reasons. Then, on the basis of what have analyzed, the essay suggests the attitude which we should hold during the construction of modem law toward contradiction: we should respect the realistic life in the countryside and try to join law and principles.
