论行规的法律效力与消费者权益保护

On the Relationship Between the Binding Force of Professional Regulations and the Protection of Consumers' Interests

行规是行业协会制定、并由行业成员共同遵守的自律性行为规范。其约束对象是行业协会的成员,是经营者自身。行规不能约束消费者的行为。现实中的一些所谓的行规违反了国家法律,对消费者的权益造成了极大的损害。国家应通过立法规范行规的制定和内容。

Professional regulations are self-restrictive behavioral rules and regulations made by some certain professional association and abided by all its members. The restrictive objects should be those runners rather than the common consumers. In fact, some professional regulations go far from its original aims. Therefore, certain statutes shall be made so that professional regulations shall not infringe the consumers' interests.
