电子提单在未来的海上货物运输,尤其是集装箱货物运输中,将有着巨大的运用空间。电子提单的实际应用取决于其能否取代传统提单的功能。文章通过分析传统提单的功能,对电子提单在货物买卖中的可转让性和在信用证结算中的担保功能进行了法律探讨。

Whether electronic bill of lading can be applied in the marine cargo transportation in the future mostly depends on whether it can replace the paper-based bill of lading. This thesis looks into the traditional functions of bill of lading and makes comparisons between electronic B/L and B/L, then concludes that electronic B/L can not replace the paper-based B/L due to the lack of legal support.
