Legal Thought on Human Gene Provider's Sharing of Interests from Legal Point of View

基因专利保护造成了基因提供者与基因研究者利益极不平衡。只有允许基因提供者分享基因的后续成果才可平衡二者利益、重构法律公平。本文论述了基因提供者利益分享的合理性 ,分析了利益分享的模式 ,主张基因提供者依据在先权利———基因信息权 ,通过与研究者谈判来参与利益分享 。

The protection of gene patent has caused a great disparity in distributing interests between gene providers and gene researchers.Only when the providers are allowed to share the final reward produced by the genes,can both parties maintain the balance of interests and can the justice be done.This thesis dwells upon the providers'right to share interests,analyses the modes of sharing interests,and maintains that the providers have the right to share interests with researchers through negotiation according to their privileged gene information right.Finally, a proposal is put forward to perfect the legislation system of interests sharing.
