中美违宪审查制度比较研究

A Comparative Study of the Chinese and American Censorship of the Breach of Constitution

依法治国,建设社会主义法治国家的必由之路是实行宪政,但宪法权威的确立不仅需要宪法本身的调整,也要求一套体现宪法精神,实现由规范层面向现实层面转化的制度,其核心内容就是违宪审查的制度建设。借鉴参考世界各国宪政建设的成功经验并认真总结本国经验教训,结合我国国情,建立具有中国特色的社会主义的违宪审查制度是我们应该追求的根本目标。

The establishment of the authority of the constitution needs not only the adjustment of the constitution itself, butalso a set of rules, the core of which is the censorship of the breach of the constitution. This paper, based on a review of theAmerican censorship, calls for the establishment of Chinese censorship of the breach of the constitution according to the Chinesesituations.
