循环经济立法研究——模式选择与范围限制

ON THE LEGISLATION OF CIRCULAR ECONOMY ——Choice of the Mode and the Limitation of the Scope

发展循环经济是我国未来社会可持续发展的最佳模式选择,法律应该保障和促进循环经济的形成和发展。本文分析了循环经济的内涵、特征及其法治化,并对国外循环经济立法作了系统分类,在分析了我国循环经济立法应考量的因素、指导思想和限制条件的基础上,提出我国应选择的循环经济立法模式以及立法范围的限制。

The development of circular economy is the best mode choice for sustainable development in our future society,and law should ensure and improve the formation and development of circular economy. This paper analyzes the definition,characteristics and legislation of circular economy, and at the same time,gives systemic classifications to the legislations on circular economy abroad. Based on the analysis of the factors,guide-thinkings and limiting conaitions that should be thought of during the legislation on circular economy, this paper also expounds the mode that should be choosed and the confinement of the scope of law.
