摘要
基于消费者的弱者地位等原因,国家有必要对消费者进行特殊保护。国家的保护并非针对所有涉及消费者权益的问题,而是局限于一定范围内。国家保护的手段主要是立法、日常监管、扶持社会中间层组织、建立公力机制等。国家保护的效能并不能像预期的那样得以实现,国家失灵、消费者自身的局限性、市场机制的排斥等因素限制了国家保护的作用的发挥。
It is necessary for the State to provide special protection for the consumers on account of the latter's weak role and other factors. The State's protection is limited within certain extent instead of covering all the issues concerning consumers' rights. The means of State's protection involves legislation, routine supervision and administration, support to the intermediate organization of the society and establishment of mechanisms with public strength. The efficacy of the State's protection is unable to be realized as expected because it is limited by factors including the disproportion of the State, the consumers' limitations and the opposition from the market mechanism.
