摘要
本文通过分析"重庆烟灰缸坠楼伤人"一案,对加害人不明的侵权责任法律适用中存在的几点争议问题提出了自己的看法,并就解决加害人不明的侵权责任的途径及法理基础作了初步的探讨。
Through analyzing the case of 'ashtray in ChongQing', this article proposes some solutions for the controversies when applying Liability for tort regulations to the cases with unknown inflicter,also makes some fundamental discussion about solving the Liability for tort cases with unknown inflicter and its legal foundations.
