保障行政权责的对等和一致,是规范行政执法行为,塑造责任政府的关键。但长期以来,在行政管理 实践中,权力与责任脱钩,有权无责现象较为普遍。“政府本位”、“全能政府”、法律法规存在漏洞和缺陷、“暗箱行 政”等等是造成行政权责失衡的主要原因。消除行政权责失衡,实现行政权责对等和一致,关键要进行制度创新, 全面构建新型的行政权责对等保障机制:加强适应现代法治社会的行政文化建设;彻底转变政府职能,实现政府责 任法定化;健全行政执法责任制;深化政务公开,扩大监督主体知情权。

However, in the practice of administration, the right and duty are disjointed and it’s a common phenomenon of right without duty for ages.The reasons causing it above are various such as “government standard” “omnipotent government” the leak and defect of the current law, underground administration. The key to banishing the imparity and accomplishing the accordance of right and duty is to carry on system innovation and set up the new mechanism securing the coherence of right and duty which can accommodate to the literature construction of modern legalized society; can keep on shifting the government function; can accomplishing the government responsibility legal; make the liability system perfect; deepen the government affair public; expand the right of the supervisor to know the inside information.
