体育知识产权的研究进展

Study on the Development of Sports Intellectual Property Right

运用文献研究法,分析体育知识产权研究的进展,结果表明: 1)体育知识产权的研究已经渗透到体育运动的各个环节,但在体育知识产权理论方面还存在许多分歧; 2)关于体育标志权的研究已经基本定论,在产权方面还不明晰; 3)体育电视转播权的研究已经基本达成共识,主要存在产权的归属和利益分配问题; 4)运动竞赛表演的知识产权是体现体育本体特点的知识产权,目前已经引起法学界和体育界的重视,开始对其研究、探讨与争鸣; 5)体育的非专利技术与体育未公开信息的研究的刚刚开始; 6)关于民族传统体育知识产权的保护已经有很多有力的证据,但目前对其研究和保护的力度不够。在此基础上,对体育知识产权的研究提出几点建议。

By using documentary method, this paper analyzes the current situation of physical intellectual property right. Result shows: research of sports intellectual property rights has permeated everywhere in sports and divarication of its theory exited at the same time; it has been done in the research of sports marks right and sports TV relay right, but a lot of problems remain in the practice; the intellectual property right of sports competition performance is the noumenal intellectual right of sports; the research just begin on sports non-patent and un-open information; although there are a lot of strong evidences, the protection of traditional and national physical intellectual property right is at the first stage. Finally, the writer puts forward some suggestions of protecting sports intellectual property right.
