战争法是历史的产物。战争法的历史发展既体现了"社会存在决定社会意识"的社会历史规律,又体现了其作为人类法制文明的内在发展规律。战争法发展的历史规律的形成,是社会历史发展客观动力机制作用的结果。认识和理解战争法发展的历史规律及动力机制,有助于我们传承人类文明成果,以战争法约束战争,维护和推动世界的和平事业。

The law of war (herein after referred to as LoW) is a historical result. The evolution of LoW reflects not only the objective law of the development of history, namely the law of 'social being determines social consciousness', but also the inherent law of its development as legal civilization of mankind. The formation of historical law concerning the evolution of LoW results from the function of the objective mechanism of the motive force of the development of society. To learn and understand the objective law of the development of history and the mechanism of the motive force concerning LoW is useful for us carrying on the heritage of human civilization and binding the war with LoW so as to maintain and prompt the peace of the world.
