“教师惩戒权”的概念辨析

Differentiation and Analysis on the Punishment Power of Teachers

以往定义教师惩戒权的概念时,对其中的“权”没有区分地一律表述为"权利“与"权力”。用语的含糊必然导致概念内涵与外延的不清。本文在对“权力”与“权利”进行辨析后,提出了教师惩戒权应是教师的权力,是教师的职权之一,从而明晰了教师惩戒权的概念以及相关的理论与实践问题。

In the past, the meaning of 'power' in the concept of the punishment power of teachers is stated by power and right indiscriminately. The vague choice of words will lead to the unclear understanding of the concept's meaning. This article differentiates and analyses the words of power and right, and argues that the punishment is teachers' powers of office, not the right of teachers.
