Thoughts on Burden of Proof of the Insured in Marine Insurance

本文从探讨海上保险举证责任配置的一般规则与例外规则出发 ,指出应减轻被保险人绝对严格的举证责任 ,并探析被保险人举证责任特殊性的缘由。同时 ,以海运货物一切险为例 ,阐述被保险人应尽的举证责任。

Based on inquiring into the general principle and exceptional principle of burden of proof, this article points out that the absolute burden of proof on the insured shall be relieved, and gives out the reasons of the specialty o f the insured's burden of proof, for example, in the case of marine cargo all risks.
