法官的职业伦理对行政官的借鉴意义

当代中国行政官的职业伦理具有泛政治化、大众化的特点。行政官的职业伦理与法治的内在要求不相符 ,必将影响行政法治的实现。在行政法治秩序建构方面 ,“人”———行政官的主观因素相当重要。通过对法官 (兼及法律家其它成员 )与行政官职业伦理的比较 ,为行政官伦理的发展与完善 ,提供可资借鉴的模式。法官的职业伦理虽然与行政官存在差别 ,但两者根本的理念应是一致的 ,即法治的精神是法官与行政官共同的伦理基础。

Political and popular as the professional ethics of the modern Chinese administrators are, the internal demands of rule of law cannot be accorded with, and then administrative rule of law will be influenced. In terms of constructing administrative rule of law in good order, the subjective factors of Chinese administrators play a significant role in it. Compared with judges' and jurisprudents' professional ethics, the development and perfection of administrators are provided with the advisable models, and different as between judges' and administrators' ethics are, both have the same spirits of rule of law.
