试论法官对强制侦查的监控权

On Judiciary Right of Supervision and Control on Forcible Investigation

法治国家普遍强制侦查的决定权赋予法官并由法官监督其使用。这对维护控辨平衡、保障公民的人权具有重要作用。而我国现状与这相距甚远 ,不能切实维护人权。因此 ,应借鉴国外的先进做法 ,将采用强制侦查行为的决定权赋予中立的、公正无私的法官所享有。

It is widely accepted in Western legal countries that the judiciaries holds the decisive rights of forcible investigation and supervise its use. It has great effect to balance of the prosecuting party and the defendant and protection of citizens' human rights. We should use overseas advanced means for reference and give the decisive right of forcible investigation to the neutral, righteous and selfless judiciaries.
