试论WTO透明度原则与我国行政公开制度的完善

On Principle of Transparency of WTO and Improvement of Our Administrative Openness System

作为WTO的成员国 ,透明度原则将对我国行政公开制度产生深刻的影响 ,我国现有的关于行政公开的零碎规定已不能适应WTO透明度原则的需要。文章通过对透明度原则的具体分析 ,提出以下措施完善我国的行政公开制度 :1、完善行政公开立法 ,为行政公开提供统一全面的法律保障。 2、建立与WTO贸易政策评审机制相对应的审议机构 ,推进贸易政策和立法的透明度与公开。

As a member country of the WTO, the principle of transparency will take profound effect on the administrative openness system of China. By analyzing the principle of transparency concretely, the thesis states following measures for the improvement of our administrative openness system: 1. to improve the legislation to provide an uniform and full-scale legal protection to the administrative openness system; 2. to establish a deliberation body corresponding to the WTO's TPRM to promote the transparency and openness of trade policies and their legislation.
