摘要
合同的相对性是整个合同法制度和理论的基础之一。同时 ,合同又在多个方面表现出涉他性。这两种现象在合同法制度和理论上表现出微妙的关系。但是正因为如此 ,才使合同法更符合人们的要求 ,更富有人情味。
While the relativity being one of the foundations of system and theories of Contract Law, the contract in many ways represents its third-party-involved nature. These two phenomena display a delicate relationship in the system and theories of Contract Law.
