摘要
电子合同的订立同样需要经过要约和承诺两个阶段。在要约阶段应探讨典型情况下要约和识别以及电子合同中要约到达生效的意义。在承诺阶段主要论证在采用不同的技术手段时承诺的不同形态、在电子环境下承诺发出的界定以及投邮生效原则在网络环境下的不适用。
There are two stages for making an electronic contract:offer and acceptance.For offer,there are different forms in electronic contract,and it is necessary to use arrival test for its force.While for acceptance,it explains what constitutes an acceptance using different technical methods,how to discern acceptance's sending out and why we can't apply postbox doctrine to electronic trade.
