大陆法系行政合同制度刍议

A Brief Comment on Administrative Contract System in Continental Legal System

行政合同是现代行政法上较为新型的一种实现行政目的的法律方式之一.法、德、日等大陆法系各国有着相当丰富的关于行政合同的理论,但各国在行政合同的概念与种类、行政合同的缔结、行政合同中双方的权利义务、行政合同的履行、解除与救济方面的理解与做法却各有不同.加强此方面的研究将为我国行政合同制度建设提供有益的借鉴.

Administrative contract is one of the new legal means to achieve an administrative goal in modern administrative law.Some civil law countries such as France,Germany and Japan are rich in the theory of administrative contract,but they differ with each other in the following aspects:concept and types of administrative contract;reaching a contract;both parties' rights and duties;contracts' performance and termination,etc.It will bring us benefits to make a study of this problem.
