To study the rule of administrative procedure law,it is necessary to comb the theory of rule of procedure law as its source at first,and examine its essence under contextual theory.The characters of modern administrative procedure,such as participation,equality,transparency,neutrality,autonomy and negotiation,make it become the important system in constructing the country ruled of law.The analysis on 3 defects of rule of modern administrative procedure law contributes to maximizing favorable factors and minimizing unfavorable ones,and then combines other systems together to promote legal construction of our country.
