摘要
反全球化运动在世界各地的此起彼伏,使得WTO在推进自由贸易的过程中越来越受到来自人权保护方面的质疑。WTO规则与人权法规则在全球化背景下存在内在联系,但对二者在国际法体系内出现冲突时的问题尚未明确。人权影响着WTO的运作,并为WTO及其规则的发展提供指引;WTO对人权已经作出了一些积极的反应,但还远远不够。WTO应当在以后的运作及具体规则制定、审查及解释中更多地考虑人权因素。
With the spread of anti-globalization world widely, the WTO, during its course of promoting free-trade, has now suffered more challenges especially from the aspect of international human rights protection. The rules of WTO and human rights have intrinsic relations under the background of globalization, however, there' re many issues still unsettled when they collide with each other. Human rights are likely to make more and profound effects on the WTO and its regulations. Although the WTO has made some responses to human rights protection, it should be more actively and comprehensively.
