摘要
中国的法制现代化建设刚刚起步,法制现代化理论还不完善。对于"现代性启蒙"以及如何对待"本土资源"的问题上还存在着争论。本文着重从争论的论题分析入手,对于理论界存在的观点进行梳理,以期能够对更深入的研究这些问题起到抛砖引玉的作用。
The modernization construction of China legal system has just begun, the theory on modernization of legal systems is far from perfection. There still exist disputes on such issues as modern enlightenment and how to treat local resources. This thesis starts with the emphasis on the analysis of the disputable subjects, then hackles the existing viewpoints in theoretical field so that it can perform the function of offering a few commonplace remarks by way of introduction so that others may come up with valuable opinions for the further study of these problems.
