摘要
为了正确认定医疗事故罪,完善医疗事故法制建设。文章对现行刑法典危害公共卫生罪中列入医疗事故 罪这一新罪名的犯罪特征与犯罪构成要件进行探讨。医疗事故罪客观方面必须“严重损害就诊人身体健康”的界定范 围不甚明了,事关医疗事故罪与非罪的关键,又是卫生监督与司法实践必须明确界定的具体问题,这一问题目前尚无具 体的规定或明确的司法解释,将是卫生监督案件移送和司法实践具体操作的难点。医疗事故罪与医疗事故的主体构成 要件不同。
To correctly identify malpractice crime and perfect law construction of malpractice, this paper discusses the criminal characteristics of malpractice crime and its components, which is just listed into public health crime in current criminal code. The definition of seriously hurting patient's health is not clear in malpractice crime. It is not only a key to judge malpractice being crime or non-crime, but also a specific issue that must be defined accurately for health supervision and judicial practice. There is neither specific definition nor accurately judicial interpretation, which would result in difficulties for transfer of health supervision case and judicial practice.
