论最密切联系原则及其在我国的运用

On the Doctrine for the Most Significant Relationship and Its Application in China

"最密切联系原则"是确认准据法的重要冲突法规则,最早运用该学说确定涉外合同之债和涉外侵权行为之债准据法的,均为美国纽约州最高法院首席法官富德(Fuld)。在冲突法立法方面,我国从一开始就接受了最密切联系原则。但是,我国现行冲突法有关最密切联系原则的立法系统性不够,整体水平尚有待提高。从现实需要考虑,我国应完善相关立法。

'The rule of the closest relations' is an important conflict law to affirming criterion law. It was Fuld, chief justice of the Supreme Court of the New York State of the United States, who made the earliest application of the law to confirm the debt of the contract and the pirate concerning foreign affairs. In the legislation of the conflict law, our country accepted the rule of the closest relations from very beginning and the standard needs to be improved. Concerning the demand of the reality, our country should consummate the related legislation.
