摘要
全国人大十届二次会议对原宪法第十条第三款关于农民集体土地的征用制度作了重大修改。本文以保障农民权益为基本出发点,对规范的征用制度的标准、"公共利益"的科学界定,及如何规范政府行为、合理实施补偿等问题进行研究并提出政策建议。
On the Second Plenary Session of the Tenth National People's Congress, the requisition system of the farmer collective land which listed as Article 10,Section 3 in the former Constitution,was amended importantly. At the present time, it's important to study the standard of requisition system, define the concept of public interests, seeking the ways of standardizing the government's action and compensate the fanner's lost, baced on the aim of guaranteeing the rights and interests of farmer.
