摘要
单位犯罪主体只能是单位本身 ,单位犯罪中直接负责的主管人员和其他直接人员不是单位犯罪的主体。单位犯罪主体的种类为公司、企业、事业单位、机关、团体。对单位的附属机构、承包单位、筹建中的单位、单位犯罪后“关停并转”的犯罪主体的认定 ,应当具体问题具体分析 。
The subject of crime of unit can only be the unit, directly responsible person in charge and other direct personnel are not the main body of unit's crime in unit's crime. The kind of the subject of crime of unit is a company, enterprises, public institution, the organazation , the group . To the subsidiary body of the unit, contractor unit, the unit while preparing to establish, asserting , should make a concrete analysis of of subject of crime of “closing, stoping ,merging and shifting ' after unit's crime, should not affirm or deny briefly .
