A Brief Analysis on the Ancient Law of China

本文以“何为律学”为契入点 ,梳理了中国古代律学的形成发展历程 ,剖析了历代律学作品所蕴含的丰富内容和特征 ,探讨了传统律学的近代转型 ,并由此阐发了关于中国古代律学的几点评论 :研究的环境是笼罩在封建专制的禁锢主义政策之下 ;研究的主体是处于附庸地位的律学家队伍 ;

This paper first explained what the law research was, then introduced the development course for the ancient law research of China, anatomized its variegated content and character, probed into its great change in the modern time. At last the author gave her own comment: It was controlled by the feudal and autocratic policy; and the researchers were almost vassals of the feudal bureaucrats; and most of its content was criminal law research.
