Scientific Principle in Compensation Claim

在FIDIC(国际咨询工程师联合会)合同条件下,监理工程师是施工管理的核心;在索赔管理时,监理工程师要公正、合理、及时地处理索赔问题,则必须坚持科学性原则。首先对索赔要有科学的认识,即对索赔的含义、索赔的必然性、索赔的作用、索赔的比例分布以及索赔的合理性要有科学的认识。其次在处理索赔问题时监理工程师要有科学的依据,主要包括法律依据、合同依据和事实依据等方面。最后在处理索赔问题时要坚持采用科学的方法来计算工期索赔以及费用索赔。

In terms of FIDIC's contract condition,consulting engineers are the core in construction management.Consulting engineers must adhere to scientific principles in dealing with compensation claims fairly and timely.Consulting engineers must first have a scientific awareness of compensation claims,that is ,the significance,inevitability,functions,distributions and rationality in compensation claims.Second they should handle the claims according to scientific basis:law,contract and fact.Finally,they should insist in using scientific methods to calculate claims of the work period and expenses.
