Potential Legal Problems in Nursing and Its Preventive Countermeasures

随着新的《医疗事故处理条例》的颁布与实施,病人的法律意识和自我保护意识日渐增强,传统的护理工作模式已不能满足现代护理的需要。为了提高护理工作的有序性,更好地维护护士与患者的合法权益,护士必须加强法律学习,正确认识举证责任倒置,提高证据意识,改进护理工作模式,改变护理记录传统模式,从法律责任的高度来约束自己的行为。

The promulgation and implementation of the Settlement Regulations for Medical Malpractice enhance, more and more the patients have awareness of law as well as self-protection consciousness. Traditional model of nursing cannot therefore meet the needs of the modern one. In order to ensure the order of nursing and legitimate rights and interests of both the nurses and patients, hospital nurses should be educated further on the law so as to understand better the burden of proof and improve the evidence consciousness. Hospital nurses should improve their nursing model, change their traditional model of recording and be self-disciplined in accordance with the law.
