网络域名的法律保护

On the Law Protection of Internet Domain Name

网络域名是一种有别于商标、厂商名称的知识产权,应将域名作为专门类别的知识产权加以保护,建立域名权利保护制度。针对我国现行法律对域名保护不利的现状,提出应借鉴国外有关域名保护的立法和司法制度,以完善我国对域名保护的法律制度。

Internet domain name is an intellectual property that is different from trademark and enterprise name, so it should be protected as special intellectual property. We should se tup the protection system of domain name rights. Based on the present situation that Chinese current law is not effective, this article suggests to use the legislation and judicial system of other countries for reference to perfect Chinese law system on protecting domain name.
