Similar Customs With Different Moral Values——An Analysis of Social and Cultural Backgroundsto the Laws of the Chu and Qin States

楚秦法律之间的冲突与互补、碰撞与融摄 ,反映了春秋战国时期中国法制演进的基本走向。比较楚秦法律的异同 ,探讨其规律 ,挖掘其精髓 ,寻求其与当代中国法律文化的某些共通精神 ,是一项具有较强理论意义和实践价值的工作。本文并非对楚秦法律进行全面系统的比较研究 ,只是从地理位置、生活环境、综合国力、历史状况、吏治观念、思想基础、价值取向、法律渊源、法治精神、法制理念等诸多方面 ,对楚秦法律的社会文化背景作了简要的分析论证。

The conflict and mutual complementarity, collision and combination between the laws of the States of Chu and Qin, reflect the basic orientation of China's legislative development in the Spring and Autumn Period and the Warring States Period. Comparison of the similarities and dissimilarities of the laws between the two states, exploration of the rules, discovery of the essence and examination of the common spirits between those ancient laws and contemporary China's legal culture, is theoretically and practically significant work. The article is aimed not to make a full and systematic study of the two states' laws, but to give a brief analysis of the social and cultural backgrounds to the laws in aspects of geographical position, living circumstances, comprehensive national power, historical situation, bureaucratic conception, ideological basis, value orientation, legal origin, legal spirit and philosophy.
