基层法律服务诉讼代理的困境与出路

The Deep End and Way out for the Litigation Agency ofthe Law Service at the Grass-roots Level

世界各国都禁止非律师人员从事诉讼代理业务。我国现行的基层法律服务诉讼代理不仅不符合世界通行做法 ,而且违反三大诉讼法、《律师法》和《立法法》的规定 ,不利于保护委托人的合法权益 。

All the countries in the world prevent non-lawyers from engaging in the litigation agency. However, at present the litigation agency of the law service at the grass-roots level in China not only doesn't conform to the current practice throughout the world, but also violates the stipulations of the three main procedural laws and ”The Law of Lawyers”and”The Law of Legislation”. It is of disadvantage to protect the legitimate rights and interests of the trustors. The law service at the grass-roots level should withdraw from the field of litigation.
