我国生命法的现状及其体系的构建与完善

The Present Situation of China's Life Law and the Design as well as the Perfection of It's System

生命法是我国的一个新兴法律部门。我国生命立法主要侧重于行政规制 ,在民事调整和刑事防范方面还存在许多空白 ,而且 ,严格来说 ,我国生命立法目前还难以真正成为一个体系。我国生命法律体系应当包括以下几个部分 :宪法关于保护人民生命健康的规定 ;生命基本法 ;单项生命法 ;与人们生命健康有关的各类卫生标准、技术规范和操作规程 ;其他部门立法中调整生命社会关系的法律规范。

Life Law is a newly developed law of China, which puts emphasis on the administrative rules while lacking in civil regulations and cirminal precautions. Strictly speaking, our Life Law hasn't developed into a system. The system of our Life Law consists of the following parts: the provisions on the portection of people's life and health in our Constitution; the fundamental life law; specific life laws; the health criteria, the technological norms and the regular procedures about people's life and health; the provisions regulating the life social relations in other laws. Our legislators should build and consummate our life law system on this basis.
