摘要
法律实证主义是西方的重要法学流派,同时又是一个饱受误解的学派。本文首先探讨了法律实证主义的定义问题,认为,法律实证主义是一个家族相似的流派。接着,讨论了法律实证主义思想的中心地带--"分离理论"和"社会事实理论",力图消除人们对它的误解。随后重点研究了对法律实证主义的批判,对这些批判分别加以驳斥和辩护。
Legal positivism is an important legal school in western history of law, which plays a great role in the development of western legal thoughts. At the same time, legal positivism receives so many criticisms that people misunderstands it. In order to understand it correctly, this article firstly compares it with other similar concepts. Then this article focuses on the key topic of legal positivism: ' separation thesis' and 'social fact thesis'. On the basis of them, this article defends for legal positivism. In the end,this article discusses the role of legal positivism in China and our suitable attitude to it.
