论GATT94第20条在实践中的新发展及前景分析——贸易与环境争端的视角

On the Future Development trend of Article XX of GATT 1994

围绕GATT94第20条发生的国际贸易争端对现今的多边贸易体制构成了挑战。虽然世界贸易组织的争端解决机构在实践中对该条作出了一定的发展,但是并未能从根本上解决问题。发达国家与发展中国家在应否对第20条作出修改的问题上争执不下。对实践中出现的发达国家由主导"规则制定"向主导"规则解释"的新动向,发展中国家应当作出积极应对。在积极参与争端解决的基础上,进一步推动世界贸易组织价值形态的转变,以"新的发展观"来指导世界贸易组织的实践,积极推动国际经济新秩序的建立。

The trade disputes on Article XX of GATT94 have brought great challenges to the basic principles of the present multilateral trade system. There is a great divergence between the developed countries and the developing countries on whether to modify Article XX or not. According to the new trend that the developed countries has been changing their predominance on 'rules making' to'rules explanation', the developing countries should take an active part in dispute settlement practice, and push the establishment of international economic new order.
